These Terms of Service ("Terms") govern your use of SmartCited, the AI-visibility scanning and action service available at smartcited.com (the "Service"), operated by the SmartCited team ("SmartCited", "we", "us"). By creating an account or using the Service you agree to these Terms.
1. The Service
SmartCited measures how AI search engines (such as ChatGPT and Gemini) answer unbranded buyer questions relevant to a business, records the sources those engines cite, and generates suggested actions. Some features let you publish content to systems you connect (such as your own website's CMS). The Service is an early-stage product: features, quotas, and pricing may change, and availability is not guaranteed.
2. Accounts and acceptable use
- You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
- You may only scan, act for, or connect systems for businesses and web properties you own or are authorized to represent.
- You may not use the Service to generate, solicit, or incentivize fake reviews; to bypass authentication, CAPTCHAs, or platform rules; to probe or disrupt the Service; or for any unlawful purpose.
- Free accounts include a limited number of scans (currently two). We may apply rate limits and quotas to keep the Service available for everyone.
3. Subscriptions and billing
Paid plans (currently SmartCited Pro at US$49.99/month) are billed as recurring subscriptions through Stripe. Subscriptions renew monthly until cancelled; you can cancel anytime from the Stripe billing portal, and cancellation takes effect at the end of the current billing period. Except where required by law, payments are non-refundable. We may change prices with notice effective from your next billing period.
4. Your content and connected systems
You retain all rights to content you provide and to content published to systems you connect. If you connect a CMS or similar system (when that feature is available), you grant us permission to transmit content to it on your instruction, and any credentials you provide are used only to perform the actions you request.
5. Scan results
Scan results reflect what third-party AI engines answered at the time of the scan. Those engines change constantly; results are informational, are not guaranteed to be complete or reproducible, and are not a promise that any action will improve your visibility or ranking anywhere. Nothing in the Service is legal, financial, or professional advice.
6. Intellectual property
The Service, including its software, design, and reports (excluding your content and the third-party engine answers quoted within reports), is owned by SmartCited. We grant you a limited, non-exclusive, non-transferable right to use the Service and your reports for your own business purposes.
7. Disclaimers and limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, SmartCited will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data; and our total liability for any claim relating to the Service is limited to the amounts you paid us in the twelve months before the claim arose (or US$50 if you paid nothing).
8. Termination
You may stop using the Service and delete your account at any time by contacting us. We may suspend or terminate accounts that violate these Terms or create risk for the Service or other users. Sections 4–7 survive termination.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced on the site or by email; continued use after a change takes effect constitutes acceptance.
